Please read these Terms and Conditions ("Terms") carefully before using the services of Mikey's Diesel Repair LLC ("Company," "we," "us," or "our"). These Terms constitute a legally binding agreement between you ("Customer," "you") and the Company.

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms & Conditions.

1. Services and Estimates

We provide mobile diagnostic, repair, and maintenance services for diesel trucks and heavy machinery. All verbal or written estimates are good-faith approximations of the costs. The final cost may vary due to unforeseen complications, additional parts, or supplemental labor required to complete the repair. We will make a reasonable effort to notify you of any significant changes to the estimate before proceeding.

2. Customer Responsibilities

  • Authorization: You authorize us to operate your vehicle or equipment for the purposes of testing, inspection, and diagnostics.
  • Safe Work Environment: You agree to provide a safe, accessible, and reasonably level work area. We reserve the right to refuse service if our technicians deem the location to be unsafe, hazardous, or in violation of any regulations.

3. Payment, Deposits, and Mechanic's Lien

Payment in full for the outstanding balance is due upon completion of services and presentation of the invoice. We accept major credit cards, T-Chek, EFS, and Comdata. Fleet accounts may be established subject to credit approval.

Deposits: For certain jobs, including but not limited to major engine/transmission overhauls or the procurement of special-order parts, a non-refundable deposit will be required before services are rendered. This deposit secures your appointment and covers the initial cost of parts. By authorizing the repair, you agree that this deposit is non-refundable and will be applied to your final invoice upon completion of the work.

Mechanic's Lien: You are hereby notified that a mechanic's lien on the vehicle, equipment, and related components will be in place until the total outstanding balance for services and parts is paid in full. In accordance with Texas Property Code, Title 5, Chapter 70, we reserve the right to retain possession of the equipment or take other legal remedies to secure payment for all services rendered.

Late payments on approved credit accounts are subject to interest at the maximum rate allowed by Texas law.

4. Warranty

All our repairs are covered by our Limited Warranty. This warranty covers defects in parts supplied by us and workmanship performed by our technicians. It does not cover failures caused by customer-supplied parts, abuse, negligence, improper maintenance, or normal wear and tear in a severe-duty environment. 5. Limitation of Liability and Indemnification

IN NO EVENT SHALL MIKEY'S DIESEL REPAIR LLC OR ITS EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF REVENUE, LOSS OF PROFITS, DOWNTIME, LOSS OF USE OF EQUIPMENT, OR COSTS OF A RENTAL VEHICLE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH OUR SERVICES.

Our total liability for any and all claims shall not exceed the total amount paid by the Customer for the specific service giving rise to the claim. You agree to indemnify, defend, and hold harmless Mikey's Diesel Repair LLC from any and all claims, damages, or expenses (including attorney's fees) arising from your negligence or your breach of these Terms.

6. Compliance with Law

We perform all repairs in compliance with applicable federal, state, and local laws, including regulations set forth by the Department of Transportation (DOT) and the Environmental Protection Agency (EPA) regarding repairs, emissions systems, and maintenance.

7. Governing Law and Jurisdiction

These Terms & Conditions and any dispute arising from our services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal suit, action, or proceeding shall be instituted in the federal or state courts located in **[Your County], Texas**.

8. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
